1. Acceptance of Terms

By accessing or using Smart Clinic ("the Platform"), operated by Smart Clinic Ltd. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Smart Clinic is a cloud-based clinic management platform providing appointment scheduling, patient records management, billing and invoicing, AI clinical notes, communication tools, and analytics for healthcare providers.

3. Account Registration

• You must provide accurate, complete, and current registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You are responsible for all activities that occur under your account.
• You must be at least 18 years old to create an account.

4. Data Ownership & Responsibilities

Your Data. You retain full ownership of all patient data, clinical records, and business information entered into the Platform. We do not claim any intellectual property rights over your content.

Your Responsibilities. As a healthcare provider, you are responsible for:

• Obtaining appropriate patient consent for data entry and processing.
• Ensuring the accuracy of patient records.
• Complying with applicable healthcare regulations in your jurisdiction.
• Managing user access and permissions within your clinic.

5. Acceptable Use

You agree not to:

• Use the Platform for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to other users' accounts or data.
• Reverse engineer, decompile, or otherwise attempt to extract the source code.
• Transmit any malware, viruses, or malicious code.
• Use automated systems or bots to access the Platform without permission.
• Resell, sublicense, or redistribute access to the Platform.

6. Subscription & Billing

• The Platform offers free trial and paid subscription plans.
• Paid subscriptions are billed in advance on a monthly or annual basis.
• You may cancel your subscription at any time; access continues until the end of the billing period.
• We reserve the right to modify pricing with 30 days' notice.
• Refunds are handled on a case-by-case basis.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

8. Security

We implement industry-standard security measures including AES-256 encryption, role-based access controls, audit logging, and secure session management. Security page and our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Smart Clinic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, resulting from your use of the Platform.

The Platform is a management tool and does not provide medical advice. Clinical decisions remain the sole responsibility of the healthcare provider.

10. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, you may request an export of your data within 30 days. After that period, your data will be deleted in accordance with our data retention policies.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law provisions. Any disputes shall be resolved in the competent courts of Israel.

12. Changes to Terms

We may update these Terms from time to time. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use of the Platform after changes constitutes acceptance.
